Can a court order for maintenance be changed if the person receiving maintenance gets a job? | Lawhive - Solicitors & Lawyers Online
Can a court order for maintenance be changed if the person receiving maintenance gets a job?
At fdr the judge awarded a sum for child and a sum of spousal maintenance on a 5 year sliding scale. The sums are based on length of marriage, age of kids and time out of employment (almost 20 years). The judge allowed a year for me to retrain to re/enter the workforce. When I do, and can hopefully work / earn, will my ex be able to change the court order on the maintenance? Or is it binding?

NQ, he can’t change it but he can apply to court for financial remedy order if your situation drastically improves (ie if your income is considerably higher, you inherited or won the lottery). This would be to stop paying spousal maintenance but he will have to continue paying child maintenance.
