Reference below clause in consent order. We understood ‘forthwith’ means immediately in this context. A penal notice has been suggested as an option to force the issue, is this expensive and more to the point is it actually effective. ?? The other party has still to all his collect personal belongings; has been served a Tort notice and the 28 days to collect are up this weekend. Again he’s stated he will do when feels like. (Has had 6 months since Court order, over 2 years since left property) The other party has said he’s ignoring the court order. 11. The parties agree that the contents of the family home shall be the respondent’s absolute property except for the items on the attached list which shall be collected by the applicant at a time to be agreed between the parties. Collection of the items shall be from outside of the family home. The applicant further agrees that he shall forthwith provide signed paperwork to effect the transfer of ownership and registration of the microchips for the two dogs, which will remain with the respondent, into the name of the respondent. Can I ask what this means, does it mean we can follow up other party’s refusal to comply? Does it prohibit a penal notice? 18. The parties shall have liberty to apply to the court concerning the implementation and timing of the terms of this order only. Dated: 12th January 2022
