If my partner and I are not married and have no children together, will his ex-wife be entitled to half our home if he dies?
My partner is coming onto my mortgage (he’s inputting the same amount of equity as myself). We are not married and have no children together. My question is, he’s still married (separated for 3 years). They’ve done a separation deed after their split, as he brought her out of the family home. In the deed it states she’s not entitled to his pension and other finances. IF anything was to happen (such as death) would she be entitled to 50% of our/my home. Will a separation deed be enough or does he need to go through a divorce and clean break? Many thanks

Solicitor ( no longer in practice). Ideally, there should be a clean break order in place before you go ahead. The status of the deed of separation will depend on whether they both had legal advice before entering into it. If they were both properly advised, it is likely that the terms of the deed would be upheld at the time of divorce even if one party attempted to go back on it.
