If your child is 12 and wants to come live with you, and the other parent does not agree, is there anything you can do?
Where do we stand if my child (12) asks to come and live with us? We’re happy to have her but not sure other parent would agree. Is there anything we can do?

NQ step mother. At that age the police and courts will be OK provided the child is in a safe location with one parent. I would strongly recommend you get legal advice on this before doing anything. The judge will want to hear what the child has to say and it has to be better than for example, my mum makes me do chores and my dad doesn’t so I want to live with my dad.

Barrister l: the best thing to do would be to apply for a live with order from the court.

Solicitor. This seems a situation ideally suited to mediation once you have had your trial period so you can address and agree the time the child can spend with the other parent. You have to have a referral to mediation before your can issue any application in court in any event.
