What are the chances of winning a case to get half of the value of a property from an ex-partner, when they put down the deposit and have been living there for 18 months?
Hi, first time writing here but I just need some help if anyone could help please. My ex partner and I have a house together, however I no longer live there and haven’t done for nearly 18 months. She is taking me to court to get me off the mortgage and title deeds without having to give me anything of what I am entitled too. I’ve asked for an offer less than 50%, just enough to give me a deposit to get a new house for our daughter and I. We have a 2.5 year old child together and she has two older children also. We have a 50:50 child arrangements order through the courts. It will cost me a lot of money to go to court so I am wondering if it’s worth going for it? There is a fair amount of money in the property and we own the house jointly 50:50 as joint tenants. However because she put down the deposit on the property which was about 40% of the property value she said I am entitled to nothing. Can anyone advise please on where I stand with this? I’ve been to tell hell and back just to get access to our daughter through courts and if I am not entitled to anything I won’t fight it. Thank you.
