What are the employee's rights if their former employer is deducting their final pay to cover damages to a company van, without proper evidence or notice?
Advice please: injured at work, they wasn’t bothered & signed off by doctor. Handed notice in and was on SSP throughout notice. Told employer I was taking legal action on injury. After leave date, Ex employer then sends me a bill for van damages (careless or negligence in contract neither of which in my situation, they also accusing me of having unreported accidents in the van ) and customer job damages (nothing in contract, I have client msgs saying they were going back to employer to sort). They then deducted my final pay from the bill without telling me in advance. No proper evidence of any of the above and the van was signed off as acceptable when it was collected. Now I’m ex employee i refused to attend a grievance meeting which they held anyway without my attendance. Outcome same and apparently I still owe this bill. Surely they have breached either the contract somehow or have unauthorised the deduction of my wages? What are my rights?

Litigation Paralegal - was your injury due to the negligence of the employer? You more than likely have a potential tortious cause of action available to you. In terms of statute, health and safety act and occupiers liability act may be relevant depending on the above.
